Terms of Service

1. Agreement

By accessing or using ChessDare (the "Service"), operated under the responsibility of chessdare.com, Barcelona ("we", "us"), you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use the Service.

2. The Service

ChessDare offers online chess play, accounts, ratings, chess challenges and related features. We may modify, suspend or discontinue parts of the Service for maintenance, security, legal compliance or product reasons, with or without prior notice where permitted by law.

3. Accounts and eligibility

You must provide accurate information where the Service asks for it and keep your credentials confidential. You are responsible for activity under your account. You must be at least 13 years old to use the Service; if you are under 13, do not register or use ChessDare. If you are between 13 and the age of majority where you live, you confirm that any parental or guardian permission required by local law has been obtained. 4. Acceptable use

You will not misuse the Service: no unlawful activity, harassment, hate speech, cheating, manipulating ratings, automated abuse, vulnerability testing without permission, excessive scraping, or attempts to disrupt other users or our infrastructure. We may investigate abuse, apply technical limits and cooperate with authorities when required by law. To the extent permitted by law, you agree to indemnify and hold harmless ChessDare and its operators from any third-party claims, damages, losses and reasonable legal costs arising from your use of the Service, your content, or your breach of these terms.

5. Your content and intellectual property

You retain your rights in content you submit (for example profile fields or custom challenge descriptions). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt technically where needed, and display that content to operate, secure and improve the Service. If you create a challenge using the Lab, you also grant us the right to offer that challenge on the platform as part of ChessDare's challenge pool (including as a selectable or randomly assigned challenge for other users), alongside our other challenges. You confirm you have the rights needed to grant these licences.

6. Third-party services

The Service may rely on or link to third parties (hosting, analytics, payments, fonts, etc.). Their terms and privacy notices may apply in addition to ours. We are not responsible for third-party sites or services you choose to use.

7. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee uninterrupted or error-free operation. Ratings, challenges and user-generated content may be inaccurate or incomplete; we do not warrant their fairness or correctness. They are for entertainment and learning, not professional advice.

8. Limitation of liability

To the fullest extent permitted by applicable law, ChessDare, its operators, owners and suppliers disclaim all liability of any kind for any direct, indirect, incidental, special, consequential or punitive damages, and for any loss of profits, data, goodwill, business opportunity or revenue, arising from or related to your access to or use of (or inability to use) the Service, any content, challenges, ratings, third-party services, errors, interruptions, security incidents or otherwise, whether in contract, tort or any other theory. Our total aggregate liability for any claims relating to the Service or these terms is zero (0 EUR). You use the Service entirely at your own risk. Nothing in these terms excludes or limits liability that cannot legally be excluded or limited under mandatory law.

9. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access if you materially breach these terms, create legal or security risk, or if we wind down the Service. Sections that should reasonably survive (for example limitations, intellectual property) will survive termination.

10. Changes, governing law and contact

We may update these terms; we will adjust the "Last updated" reference when we do. Continued use after changes may constitute acceptance where allowed by law. We may assign or transfer these terms, in whole or in part, to any affiliate or successor without restriction.
